How the Guardianship Process Works
A simple overview: From the first request to receiving support.
Phase 1: The Beginning
The Request (Notification)
Someone informs the court that support is needed. This can be done by family members, or you can apply yourself.
Mail from the Court
The court reviews the request. You will receive a letter confirming that the process has started.
Phase 2: The Assessment
Meeting with the Authority
Guardianship Authority (Betreuungsbehörde): An official will speak with you personally to see if legal support is truly necessary.
Medical Consultation
An independent specialist doctor will talk to you to determine if you need support from a medical perspective.
Phase 3: The Decision
Visit from the Judge
The judge visits you – usually in your own home. They will listen to your wishes and clarify questions personally.
Official Start
You receive the court order. Your legal guardian receives their official ID and can now legally act on your behalf.
Good to know

Since the 2023 reform, your wishes are the central standard (§ 1821 BGB). I identify your wishes, discuss upcoming decisions with you and support you in handling matters yourself as far as possible within the court-assigned scope.
No.
Legal "incompetence" (Entmündigung) was abolished in Germany in 1992.
- Legal guardianship alone does not remove your legal capacity.
- Legal capacity is assessed independently from guardianship in each individual case.
- Legal care is legal assistance, not guardianship.
Yes, you can.
According to § 1816 BGB, you have a right to express wishes:
- You can suggest a specific person as your guardian.
- You can also say whom you do not want as your guardian.
- The court generally follows your proposal if the person is suitable for the role.
Tip: If you wish me to be your guardian, you can simply communicate this to the court.
No. That's an important misconception.
Legal guardianship is legal care, not practical daily assistance.
- What I do NOT do: Clean, cook, provide nursing care, or shop.
- What I do: I organize these services for you. I hire care services, household help, or meals-on-wheels and ensure they work properly.
You can ask the guardianship court to consider a change.
- The court reviews the legal requirements and hears the people involved when necessary.
- A change may be considered if an at least equally suitable person is willing to take over (§ 1868 BGB).
- I don't take it personally – trust cannot be forced.
My goal is for you to feel well cared for. If the chemistry isn't right, a change is the right decision.
The remuneration is regulated by law. If a person is considered without sufficient means under § 1880 BGB, the professional guardian's remuneration may be paid by the state treasury under § 15 VBVG.
Otherwise, remuneration is generally paid from the assets that must legally be used. This is assessed individually under the applicable rules.
A power of attorney or other forms of support can make guardianship unnecessary.
This applies when the power of attorney is effective and sufficient and a suitable trusted person can handle the required matters equally well (§ 1814 BGB).
I provide honest orientation: If another form of support may take priority, I say so and, where appropriate, refer you to the competent guardianship authority, a guardianship association, a notary or a lawyer.
My goal is not to have as many clients as possible. My goal is for you to get the best solution for your situation.
Both instruments help when you can no longer manage your affairs yourself – but in very different ways.
With a power of attorney, you decide in advance who represents you and within what scope. An effective and sufficient power can make the appointment of a guardian unnecessary. With legal guardianship, the court appoints the guardian and must generally respect a suitable choice expressed by you.

I have the legally required registration according to § 24 BtOG (Care Organization Act). This confirms my personal and professional suitability as a professional guardian to the Berlin guardianship authority.

Then you can take the following steps:
- Seek orientation – From a guardianship authority, a guardianship association or in my non-binding initial conversation.
- Check alternatives – Is a power of attorney sufficient? Is there family support? What social benefits are available?
- File an application with the guardianship court – If other help is not sufficient.
Important: A guardian may not be appointed against an adult's free will (§ 1814(2) BGB).
Can I become a guardian as a family member?
The court considers family relationships, personal ties and possible conflicts of interest. A professional guardian should be appointed only if no suitable volunteer is available.
